President’s Message – by Ken Simpson
The ranch is starting to green-up. As I write this we have just been blessed with an approximate one inch of soaking rain. This, together with 44 inches of snow this winter is a good start to the growing season. Robins, bluebirds, doves, house finches, fly-catchers and what all have either passed through going north or are sticking around. Here on Kaitlyn Drive we have seen mule deer and pronghorn nearly every day. The resident cows, by our count, gave birth to eight calves over the late winter / early spring months. Greenhorn Mountain and Pike’s Peak still have a good snow-cap and are imposing. All-in-all this is a pretty good start for life on the ranch in 2005.
Budget Summary:
The enclosed Budget Summary proposed for the period July 1, 2005 to June 30, 2006 is for your review and approval / disapproval. (See Page 2) If approved by a majority of all property owners eligible* to vote (one vote per parcel) the proposed budget will be ratified at the June 25, 2005 annual meeting.

Profile: Nicole Swartwood, ERPOA Vice President
Nicole and her husband Ron have lived in their ranch style home on Siegel Way since 2003. Nicole grew up in this area and her parents still live on the family ranch, just off of Burnt Mill Road, where her father has lived since he was 12 years old. She also has a brother and sister in the area. Ron also grew up in the Pueblo area; his family lived on the Mesa (East of town). They met through 4-H Horse activities and have been married for five years. Nicole works for R Buck Heating completing a variety of accounting and office tasks. Ron is an Assistant Director of Financial for Pueblo Community College. They liked Eagle Ranch for the easy access to their Pueblo jobs in addition to the views afforded with the horse property. They enjoy outdoor activities and are often seen riding their horses on summer evenings. They also have three dogs and two cats to keep them company.
Ron’s Dad performed the duties of Project Manager for them as their house was built. They did a little of the work themselves. Their well is 542 feet deep and they have a 1,500 gallon cistern. They felt a cistern was important since during the drought years many in this area had wells go dry. There is extra water available for emergency use and also with the cistern water can be hauled in if necessary and stored. Nicole’s advice to those of you who have yet to build is to maintain close supervision of the activity.
Profile: Allison Oswald - ERPOA Secretary
Allison grew up in Oil City, Pennsylvania. She obtained her undergraduate degree from Gannon University and completed her Master’s at Lesley University. She currently teaches 5th grade at Highland Park Elementary in District 60. Allison likes to spend time outside hiking and skiing. Unfortunately she was unable to take advantage of the best ski season in decades this winter, since she could not ski, since she is pregnant. She also loves to swim and read.
Allison met her husband, Jeff, in Espanola, New Mexico, just outside of Santa Fe where she was a missionary/ AmeriCorps volunteer with the United Methodist church and he was a teacher at the school where she was working. Jeff is originally from Kansas City, MO and moved to NM to go to The College of Santa Fe. She and Jeff have been married 2 ½ years now. Jeff teaches 7th grade social studies and science at Risley Middle School in Pueblo. They came to Colorado to teach and take advantage of the favorable cost of living. Neither of them have family in Colorado, so it is a great place for their families to visit.
They have three very spoiled dogs. Wheeler and Taboo are 6 year old German Shepherds but don't tell them they are dogs. Little is a part blue heeler and part terrier mutt that was rescued at Jeff's school. She rules the roost. There is also Patches the cat who lives in the basement and does a great job of hunting mice.
Allison and Jeff were drawn to Eagle Ranch for the affordable land close to town and the spectacular view. They also liked the fact that it is a covenant controlled community. Their well is about 550 feet deep and they have a water filtration and softener system. They did the general contracting themselves and hired various contractors when building their home. They also spent considerable time shopping at Home Depot. Allison suggests that you consider wiring your home for a generator, since we do have occasional power outages during the winter months.
Fencing:
Covenants Article 3, Section 3.5 – Fencing, states “All animals kept by a Lot Owner must be fenced within the boundaries of the Lot.”
• Dogs should not be unattended, nor should they be allowed to chase cars, hikers or horseback riders.
• An animal caught chasing cattle or wildlife can legally be shot.
• Please be thoughtful of your neighbors and watch out for the safety of your pets.
Burnt Mill Road Paving Petition

TO: PUEBLO COUNTY COMMISSIONERS
RE: SECOND REQUEST TO PAVE BURNT MILL ROAD
We the undersigned request that the Pueblo County Commissioners pave Burnt Mill Road beginning in year 2005. The traffic level along Burnt Mill Road is extremely high largely due to the increased number of residents that have moved into Colorado City, Eagle Ranch, St. Charles River Estates, as well as other areas along this sector over the past several years. The condition of Burnt Mill Road is very poor and in dire need of continual maintenance. During rainfall and snowfall, the road is an extreme hazard as a result of potholes, slick and icy conditions, as well as large ruts that form. The occasional magnesium chloride treatments that the County applies to the road are no longer effective. The high traffic level combined with the poor condition of the road has resulted in a serious safety issue, as well as increased damage to vehicles. In year 2004 there was another fatality along Burnt Mill Road, and recently there was also another truck that rolled over.
As previously reported to the Commissioners, we were advised that Red Creek Ranch deposited $1,240.00 into an escrow account payable to Pueblo County for each lot sold in the St. Charles River Estates subdivision. Since all 64 lots have been sold, this is approximately $79,360.00. Each time a building permit is pulled the County can access these funds, which were to be used to improve Burnt Mill Road and bring it to a higher standard. In addition, according to the Pueblo County Assessor’s website, the County collected approximately $83,811 in property taxes from St. Charles River Estates lot owners in year 2004 alone. This does not account for the taxes paid by the lot owners in Eagle Ranch and others who reside along Burnt Mill Road. The tax revenue collected by the County will greatly increase in year 2005 and beyond as additional homes are constructed and the County assesses taxes on the improved land as well.
This increased revenue collected by the County should greatly defray the cost of paving Burnt Mill Road. We are aware that Burnt Mill Road covers a several mile radius, and it would be cost prohibitive to pave the entire stretch of road in one single year. Therefore, we are requesting that the County phase the paving work over perhaps a three year period beginning in year 2005 starting with the portion from I-25 to where it intersects with Little Burnt Mill Road. Trash – by Debby Graham
With the recent spring winds there has been a noticeable increase in the amount of trash blowing around all over town. This was even noted on the nightly news.
The Covenants, Article 4 – Maintenance Standards, Section 4.2 – Refuse, state:
“No unsightly objects or materials, including but not limited to ashes, trash, rubbish, garbage, grass or shrub clippings, scrap material or other refuse, or receptacles or containers therefore, shall be stored, accumulated or deposited outside or so as to be visible from any neighboring property or adjoining street, except during refuse collections.”
There are companies in Colorado City and Pueblo that provide trash services to our area. Some pick up weekly others pick up monthly, depending on your preference.
• Store your trash container where it is not visible to others.
• Keep your dumpster or container covered.
• Pick up trash on your lot when you see it.
Please do your part to help eliminate blowing trash at Eagle Ranch.

Easement - By Ken Simpson
It is brought to attention that there is an obvious discrepancy between the 75 foot easement indicated in the covenants Article 9, Section 9.1, and the 60 foot right of way (ROW) reflected and scaled on the Eagle Ranch Plot Map provided at the time of purchase. This matter is currently being addressed, however, it is noted that the easement, be it ultimately 75 foot or 60 foot, is for non-exclusive use and access by all lot owners and their invitees, i.e. the easement cannot be obstructed.
