Eagle Ranch Property Owners Association Board Meeting – January 13, 2014

The meeting opened at 6:39 pm
1. Treasurer’s Report – Ken S. gave a verbal treasurer’s report. He stated that as of 12/31/13 our bank balance was $11,012.80. he also stated the figures as of today, as we received several common assessment payments. Those statements went out in the beginning of this year. Total delinquency amount is $10,788.28. Ken stated that several accounts have been closed out by the collection agency and he went into detail as to the status of each delinquent account. Tom mentioned that we have our lawyer send out letters to the new delinquents, before we possibly turn the account over to either our current collection agency, or start dealing with a new one, since we do not get timely updates from our agency now. Ken stated that our biggest debt is from an owner with two lots, living in California. Since 2008, we have been unable to get any response or money from the 2 lot owner, and our lawyer cannot deal with out of state clients. Taxes for the properties are being paid, but the collection agency has been unable to get any money from the lot owner. Several of the delinquents who have paid their debt to the collection agency still owe us money and we now have to decide on whether to go the lawyer with those debts or to the agency again. Liens and default notices will be filed, where appropriate. Ken will issue an income expense statement by the end of March.
2. Kaitlyn Bridge – Tom A. mentioned that the condition of Kaitlyn bridge, although functional, is not very appealing. The board had decided at previous meetings NOT to cover Kaitlyn bridge until our road grader was fully paid off. Ken stated that we have 7 more payments to make on the grader.
3. Road Grading - Several people are interested in doing the grading of our roads. Tom mentioned that until the grader is paid off, Evan will continue to do all the grading. The board members want Evan to do the training of potentially new grader operators. Tom mentioned also that we need to have someone who could do road repair in an emergency, as it would take Evan 4 hours to drive here, should an emergency arise. The same holds true for snow removal. Tom stated that we would remove 8” or more of dry snow, or 4” or more of wet snows, once the snow has stopped falling. There is a person interested in doing the snow removal, and Tom will be talking to him. With some of the heavy rains that we had last year, parts of Nolan and Siegel were washed out and the ditches along the roads will need to be cleared out. To do this we will need special blades on the grader. Evan gave Tom a contact who could get us a good deal on the blades. Last year we did “spot grading”, as opposed to grading all the roads. Tom would like to continue with this method, as we paid only $800 to do the “spot grading” versus more than $4,000, to grade all 11 miles of our roads. This “spot grading” would be done on parts of the various roads that need to be graded at that time.

Eagle Ranch Property Owners Association Board Meeting – October 20, 2014

The meeting opened at 6:58 pm
1. Treasurer’s Report – Ken Simpson had written up the following figures for Tom Ossner to read at this meeting – We have $28,040.36 in the savings account and as of 10/20 we have $4,802.11 in the checking account, giving us a total of $32,842.47. In the 2014 unpaid Special Assessments, which are due on 10/31/14, at this point we need to collect $5,425. In past due assessments from 15 lot owners, we are short a total of $9,754.42. We still owe $2,083.32 as payment for the grader, which should be paid up some time in 2015. There is a deceased two lot owner, whose estate owes us more than $4,500, where our ERPOA could possibly buy the two lots for about $6,000. Tom is looking into that possibility.
2. Road Grading – Tom said that some of the ditches along the sides of our roads need to be redone. Winter times would be best to do it, so we may look into doing that this winter season. Bob Robler stated that, in addition to several people living here on the ranch who are interested in doing the grading of our roads, he knows of some county road grader operators, who might be interested in grading our roads. Tom mentioned that until the grader is paid off, Evan will continue to do all the grading, and Evan would be willing to teach the potential new operators how to use the grader.
3. Meeting with Lot Owner – One of our delinquent lot owners wanted to meet with Tom to discuss the liens on that property and other unknown topics. The owner has not replied to Tom’s query as to what the topics are. Tom invited that lot owner to come to one of our board meetings, as this is ERPOA business, he would not meet with that person by just himself.
4. Renting our Grader – Tom stated that there might be an interest by some homeowners to rent our grader for doing work around their property. We discussed that possibility and that there would be a charge for the equipment usage, as well as the operator. Ken Martin said that he is definitely interested in having some grader work done. Bob mentioned possible liability problems, which raised the subject of insurance agent. Tom said that he is still having policy problems with the new agent and that he is thinking of possibly using an agent from the Denver area. We would probably charge by the hour, which would include the use of the grader, operator expense and mileage to and from the lot location. Bob mentioned that there may be an IRS concern for our non-profit organization making money on the rental of our grader.
5. Siegel Way – Bryon Bowers, a resident on Siegel Way wrote an email to all board members, stating that the Siegel Way road has deteriorated into very bad shape. There are deep ruts and potholes in the road. Tom will reply to that email, assuring Bryon that grading will begin this coming weekend. There were 270 tons of road base applied to Siegel Way at our last grading.
6. Marijuana Growing Facility – A property owner had expressed a concern over a marijuana growing facility on our ranch. No action was taken by the board regarding this concern, but further research will be initiated.
