2013 Eagle Ranch Property Owners Association Annual Meeting,
held on June 29, 2013, at the Lamb Branch Library, in Pueblo, CO
Present – Four board members - M-a-L was not present,
5 other lot owners
The meeting was opened by president Tom Ossner at 11:30 am.
1. Proxies – With 4 board members and 5 voting lot owners present and 19 mail-in proxy votes, we had enough votes for a quorum at this annual meeting. The quorum was only 20 votes, as we had 18 delinquent lot owners, that were not counted in, to come up with the quorum figure. The vote for the 2014 budget and assessments was approved 25 to 2, and 3 abstentions.
2. Annual Meeting Minutes – The 2012 annual meeting minutes were read by secretary Horst Armbrust. These minutes can be read on our website – ERPOA.US. The minutes were approved by the membership.
3. Disclosure Statement – The 2013 meeting disclosure statement was read by Tom Ossner, and he stated the agenda for this year’s meeting.
4. Treasurer’s Report and Past Due Assessments – Treasurer Ken Simpson handed out (copy attached), and gave an explanation of the Treasurer’s Report. For the period of January 1, 2013 through June 28, 2013 our income exceeded expense by $11,423.40. Ken talked about the past due annual and special assessments, and how difficult it is to collect these monies. At one point this year we had a 21% delinquency rate, which has come down to the present 14%. We have 15 accounts (lots) that owe more than $25.- Four of those accounts are turned over to a collection agency and another two accounts are being handled by our association lawyer. Two other delinquent accounts are not turned over for outside collection and the remaining seven accounts (lot owners) will receive a default notice next month and after a short grace period, the still delinquent accounts will be turned over to the collection agency, or the lawyer. All extra expenses incurred from the lawyer or the collection agency (as high as 40% extra per payment) will be the added on to the delinquent lot owner’s outstanding amount.
5. Road Grader/grading – Ken talked about our purchased grader expense. We currently have a balance of less than $18,750, which is being paid in 9 interest free installments. Ken compared a previous grading cost with the grader being owned by Evan’s Earthworks, which came to about $5,563.- for the 11 miles of Eagle Ranch roads, to a grading done about a month ago, using that purchased grader, at the cost of $2,619.-. So by saving almost $3,000.- per grading, we will eventually recover the cost of the grader. Other costs associated with equipment and grading our roads are included in the 2014 budget. Tom mentioned that Evan’s Earthworks has been dissolved, but Evan is still doing the grading, although he now lives in the northern part of Colorado. After the grader is paid off, Evan will train several ERPOA members who showed an interest in learning how to use the grader, so that the gradings can be done using association equipment and drivers. Other items concerning the grading work and equipment were discussed with various lot owners that were present at this meeting.
6. Bridges – Tom stated that the Kaitlyn Dr bridge covering is being put on hold, until the grader is paid off. This bridge abudment was not installed according to specifications, so other bridge abudments need to be inspected, before any covering is put on the Kaitlyn bridge.
7. Mail-in Questions – Some questions were sent in via the Proxie/RSVP replies. No progress has been made toward replacing the street signs of the various Eagle Ranch entrances. The lack of a proper entranceway on Reba Ct was discussed with the lot owners on that street, who were present at this meeting. Another question was mailed in about getting irresponsible home owners to pick up their trash, rather than letting it blow on someone else’s property. The home owner should be contacted directly and encouraged to pick up their trash. If they do not comply, then the Sheriff’s Office should be contacted. Speed bumps on the roads? Tom said that Nolan and Siegel get about 70% of all the road base delivered and had two gradings this year, compared to only one grading for the other roads. Many drivers using these two streets must slow down to the 25 MPH posted speed limit, in order to keep those roads in better conditions. If you see speeders, then talk to them and ask them to slow down. A question was raised about trespassing. Home owners do not have the right to trespass, either on a horse or a motor vehicle, on other lot owners’ property. If talking to the offender does not help, then again the Sheriff’s Office needs to be notified.
