Dear Eagle Ranch Property Owners:
In accordance with our by-laws, this newsletter is the official notification of our annual meeting to be held on Saturday, June 26, 2010.The meeting will be held at Fort Sonset located behind the Wild West Cowboy Church at 1025 S. Prairie Avenue, Pueblo, Colorado 81004.
The meeting will begin at 11:30 AM sharp. It is recommended that you arrive in sufficient time to sign the register. Registration starts at 11:00 AM.
The following should be noted:
1. Only members in good standing with the POA will be allowed to vote. All dues must be paid up to date. Delinquent payments will be accepted at the meeting via cash or cashier’s check.
2. The meeting will follow a strict agenda. Only the subjects that are listed will be discussed. If you have an item or question you feel should be included, it must be sent to the board in writing by June 1st. It will be reviewed by the board and either answered individually or added to the agenda. (Note: Space provided on ballot)
3. In an effort to reduce cost, a meal is not planned. Light refreshments will be provided.
Please use the enclosed form for proposed budget approval and RSVP. Be sure to indicate the number attending so that we can plan accordingly.

Brief meeting of new Board members to select officers
ELECTION:
Since this is a term expiration year, all five positions will be open. You will be provided with a paper ballot which will state the name of the current Board Members running for reelection and blank lines to record any floor nominations. All current board members are residents on Eagle Ranch and are willing to run again. It is highly desirable that board members live in the Pueblo area. Therefore, we appeal especially to local property owners, who are interested in becoming a board member. If you would like to be considered for a role on the board, please indicate on the attached Ballot and RSVP form. Please keep in mind, in accordance to the By-laws (Article 5, Section 2), members are only voting for members of the board, not offices. At the conclusion of the annual meeting, the new board members will decide who will hold each respective office.
At this time I would like to thank the current board members for their sacrifices and time. We have had more meetings (a lot impromptu) this year than ever before. Again thank you.

State of the Roads:
This year has seen the completion of several road projects and the start of others. The subcontractor working on the bridges has completed his work. Road base was returned to Nolan’s surface. The board would like to thank everybody for their patience since the start of that project. The completion date was drawn out several times due to the dissatisfaction of the board, as well as current residents, with the work of the bridge contractor.
On another note, Abbey Lane in the Shadow Lane complex had base put in place in anticipation of new residents. A lot more work is needed however for the remaining portions of Shadow Lane. This will be the biggest project left to tackle.
That being said, any one wanting to participate should join the road committee. The road committee currently has four members including myself. Its effectiveness since inception has been slow to develop. Ideas on how to make the committee more effective and efficient are always welcome.

The annual meeting held June 27, 2009 had poor attendance. There were not a sufficient number of property owners for a quorum; therefore no official business could be conducted. Since the 2010 meeting will include election of officers, we urge you to participate either by attending the meeting or returning your proxy included in this newsletter.

Why do I have to pay Eagle Ranch Special Assessments?
a) I don’t live there,
b) I don’t use any of the roads being repaired,
c) I don’t ever visit my property; it’s just an investment,
d) I think it’s too much money,
e) or other reasons you may have.
There are several reasons you have to pay the Special Assessments.
When you purchased your lot, you became a member of the Eagle Ranch Property Owners Association, and legally agreed to abide by the Covenants and By-Laws.
The Association’s primary responsibility and expense is the upkeep of our subdivision roads and bridges.
The ERPOA Board has the authority to establish Special Assessments without a vote of the membership. The Board is limited by Colorado Law in that total Assessments (Annual Dues and Special Assessments) may not exceed $400 yearly. We have held at the $300 level since 2008.
At the Annual Meeting in 2008, the members voted to not increase the $200 Annual Dues, but to instead pay a Special Assessment yearly as needed for road and bridge repairs that are above and beyond our normal road maintenance budget.
The three bridges and the Shadow Lane complex at the north end of Eagle Ranch all needed repairs not covered by our normal budget.
All members of the Association share costs in common, no matter where their lot is located on Eagle Ranch.
All members benefit by having well-maintained roads. It keeps property values up, and makes travel on the Ranch much safer.
Collection of past due regular and/or special assessments will continue to be pursued in accordance with actions outlined in Article 8 of the Covenants.

2009 Special Assessment
Due $100.00 per lot
Due date: August 1, 2009
Past due date: November 1, 2009
The Eagle Ranch Board of Directors and Road and Bridge Committee have determined that the repair of the 3 bridges (Reba Ct., Kaitlyn Dr. and Nolan Dr.)is more critical than the Shadow Lane road complex, so all of the 2008 Special Assessment monies will go to bridge repair. A Special Assessment for 2009 will also be collected for bridge repair, and if money is left over, it will go towards the Shadow Lane road complex. A further Special Assessment will be necessary in 2010 to continue the Shadow Lane project.
Accordingly, a special assessment of $100 per lot is being levied at this time and will be due between August 1 and November 1, 2009.
This special assessment is governed by the guidelines stated in Article 8, Section 8 of the covenants. With regard to Section 8; it is noted that the total of common and special assessments has been increased to $400 from $300 per revision to the Colorado Common Interest Ownership Act, to which the ERPOA is subject. We are holding at the $300 level as long as possible.
